After the appeal by Juventus (against the 15 - point penalty ) and by former president Andrea Agnelli (a 24-month ban), now comes another one from the former CEO of the Bianconeri club, Maurizio Arrivabene.
Capital gains case, Arrivabene appeals against inhibition
The Guarantee Board , in fact, received the appeal of the former CEO against the FIGC and the federal prosecutor "against the decision of the Federal Court of Appeal at the FIGC, issued on 20 January 2023 and filed on 30 January 2023, in the context of the proceedings against Fabio Paratici and others".
Arrivabene's requests to the Guarantee Board
With his appeal, Maurizio Arrivabene asks the Guarantee Panel : "primarily, to annul without referral the contested decision due to the inadmissibility of the appeal for revocation by the Federal Prosecutor's Office, as the investigative documents transmitted by the Public Prosecutor's Office at the Court of Turin do not constitute 'new facts' capable of overturning the ratio decidendi of the revoked sentence."
“Secondly, to annul without referral the contested decision for violation of the principles of adversarial proceedings and due process established by Articles 111 and 24 of the Constitution, Art. 6 ECHR, Art. 2 CGS CONI and Art. 44 CGS FIGC, as well as for violation of the right of defense, due to the lack of correlation between the accusation contested in the referral and the sentence rendered at the end of the revocation proceedings”
“Furthermore, to annul without referral the contested decision for violation of articles 4, paragraph 1, and 31, paragraph 1, Cgs Figc in relation to the alleged intention of the defendants to avoid the application of an accounting principle not applied in the sector at the time and not even ex post effectively ascertained in the sentence as applicable in the specific case”.
