arzano – Acquittal because the act does not constitute a crime for three municipal employees who had waived the statute of limitations.
The Attorney General's Office opens a disciplinary file. The local police lieutenant Vincenza Merolla, the agent Alfredo Sora and the municipal surveyor Francesco Aruta involved in the affair that led to the arrest of the traffic warden Rosa Mastrocinque, already convicted on appeal for a series of building abuses covered up by her colleagues, were acquitted after having waived the statute of limitations.
But there was not even time to breathe a sigh of relief for the acquittal that Sora, Merolla and Mastrocinque (not acquitted) will have to defend themselves from the Attorney General at the Court of Appeal of Napoli which censured the behavior of the three policemen who, after the accusations, have already filed their defense briefs.
While waiting to read the reasons for the sentence that do not fully acquit the convicted, since the act charged, although committed by the accused and although existing in its objective elements, does not represent a criminal offence, because, for example, the subjective element is missing, the Attorney General has issued a decree of indictment.
The Attorney General, after their defense, may opt for either archiving, suspension, interdiction or disciplinary measures. In the meantime, just a few days ago, the Prosecutor's Office of Naples North began a series of interrogations precisely on some events that led to the convictions in the first degree and appeal always relating to the same event.
