The 58-year-old Carabiniere Giuseppe Molinaro, who on March 7 killed with his service pistol the 67-year-old hotel manager from Castelforte, in the province of Latina, Giovanni Fidaleo, seriously wounding the 31-year-old Miriam Mignano, currently hospitalized at the Gemelli in Rome, remains in prison.
The investigating judge of the Santa Maria Capua Vetere court did not validate the arrest ordered by the prosecutor, as there was no risk of escape (Molinaro has been in the military prison of Santa Maria Capua Vetere since the day of the incident), therefore he issued a custodial order against the carabiniere, in which he excluded premeditation, and then declared his lack of jurisdiction for the territory, as the episode occurred in lower Lazio. The documents will now be sent to the competent prosecutor's office of Cassino.
During the preliminary hearing held today before the investigating judge, Molinaro, in the presence of his lawyers Giampiero Guarriello and Paolo Maria Di Napoli, confirmed what he told the Carabinieri in Capua a few hours after the crime, that is, that he had gone to the hotel in Fidaleo to clarify "once and for all" the sentimental connection that involved both of them and which had 31-year-old Mignano at its centre.
Molinaro and the woman, the carabiniere said, had in fact met in the hotel parking lot, where each had arrived with their own car. The 31-year-old rang the bell of the accommodation facility.
The victim had attacked the policeman who shot and killed him
Molinaro reported that when Fidaleo saw him, he grabbed a crowbar, so he could no longer see, and fired several shots with his service pistol, which fatally wounded Fidaleo.
Mignano tried to stop Molinaro by grabbing him, the soldier turned around and shot and hit the 31-year-old. The carabiniere's lawyers have announced that they will request an expert opinion to assess the 58-year-old's mental health.
