The Supreme Court of Cassation, III Section (President Luigi Marini, rapporteur Antonio Corbo), accepting the appeal of the lawyer Vittorio Fucci, has annulled the order of the X Section of the Review Court of Napoli, which had rejected the appeal against the request to revoke the pre-trial detention in prison of Gennaro Morgillo.
The man had been arrested, together with other people, by order of the preliminary investigations judge of Santa Maria Capua Vetere in October 2021, on charges of aggravated drug dealing relating to 33 charges.
Morgillo, 34 years old, from S. Felice a Cancello, is presumed responsible for a large drug dealing network that particularly concerns the Sannio and Irpinia municipalities of the entire Caudina Valley.
The Supreme Court of Cassation, annulling the order of the Review Court, upon appeal by Attorney Vittorio Fucci, has ordered a new trial before a different Section of the Review Court of Naples.
