The hearing before the preliminary hearing judge of the Court of Avellino, Paolo Cassano, for the murder of Nicola Zeppetelli, 40 years old, from Cervinara, against Alessio Maglione, 31 years old and Giuseppe Moscatiello, 23 years old, both from Cervinara. The lawyers of the Zeppetelli family members, who joined as civil parties, are Vittorio Fucci for 5 relatives of the victim and Rolando Iorio for one relative of the victim.
We recall that the trial was severely damaged in the investigation phase following the fact that the DDA took over the investigations until about a month before the preliminary hearing, to verify whether there were links with organised crime in the Zeppetelli murder case and therefore whether there was a Camorra matrix.
However, since the DDA believed that there was no mafia involvement, it forwarded the investigation file about a month before the preliminary hearing to the Avellino Prosecutor's Office which, given the very limited investigation time, did not contest the aggravating circumstances of cruelty, futile motives and premeditation in the indictment, allowing the defendants to proceed with the abbreviated trial, which determines, regardless of the outcome of the trial, a reduction of 1/3 of the sentence decided by the judge.
In particular, the lawyer Vittorio Fucci has tried to fill the compromise of the investigation phase, proceeding with several autonomous defensive investigations, then transmitted to the Prosecutor's Office and respectively to the Gup. However, there remains the gap in the investigations of the Public Prosecutor, holder of the power of criminal action in the process.
