With ruling no. 3635, published today, the Council of State rejected the appeal against the Campania Regional Administrative Court's ruling that upheld the legitimacy of the regional measure revoking Giano Ssd's concession to use and manage the Collana di Napoli plant.
“The Council of State – reads a note from Palazzo Santa Lucia – reaffirmed the correctness of the provisions with which the President of the Region appointed a commissioner ad acta to verify the management of the agreement with the concessionaire and of the provisions with which – on the basis of the commissioner's investigation – the concessionaire's forfeiture was declared for serious violation of the obligations undertaken”.
The note continues: "Among the other circumstances ascertained, the sentence highlights the change in the corporate structure of Giano, which determined the transition from a sporting nature to a substantially entrepreneurial one of the company; as well as the direct assignment of the works to a company connected to Giano itself, in violation of the rules that impose the carrying out of a public tender and the possession by the contractor of SOA certifications to guarantee the quality of the workmanship".
“At the end of a long-standing dispute, the facility is finally back at the disposal of the Region, which has long intended to entrust it to the Regional Agency for Sport (Arus) to ensure its use by users, preserving its social purposes and the promotion of sport even by the weakest groups”, it is underlined from Palazzo Santa Lucia.
