The President of the Autonomous Province of Trento, Maurizio Fugatti, signed a new culling order last night for the bear Jj4, captured by forest rangers and confined in the Casteller enclosure in Trento after attacking and killing Andrea Papi, 26, in the woods of Caldes, in the Valle di Sole.
The first culling order was suspended by the TAR of Trento after the appeal of animal rights associations, which are now announcing a new battle against the measure. LAV has also announced that it will present a warning to the Prosecutor's Office and the Carabinieri to the Apps, against the execution of the animal which would constitute - say the
animal rights activists – the crime provided for by article 544 bis of the Penal Code, two years of imprisonment for the instigators and perpetrators, of killing an animal “without necessity”.
“The date of next May 11, in which the TAR in collegiate session should have provided the final verdict on the bear JJ4, given the withdrawal yesterday evening by Fugatti of his first two ordinances, therefore remains the day in which the Trentino veterinary ASL, by order of the provincial President, has the mandate to carry out the death sentence of the animal”, writes LAV again.
The suppression of the bear Jj4, the provision states, will be "suspended until May 11, 2023, when the collegial discussion of the precautionary incident relating to its contingent and urgent ordinances will take place before the Trento Regional Administrative Court".
The animal's suppression "should be carried out as soon as the results of the precautionary incident mentioned above have been received".
The ordinance believes that "as a precaution for public health and safety, it is reasonable to kill the animal, rather than accept even the slightest risk that it
the same person may again come into contact with a person, even during all operational phases aimed at the possible transfer of the same person to another location".
“It should be considered that to date – we read further – the Province does not have a concrete alternative envisaged in the precautionary decrees of the president of the Trento Trga (..) that is, that of a possible transfer of the bear Jj4 to another site outside the Trentino Alto Adige/Südtirol Region, even abroad, which absolutely offers high standards for the safety and security needs of its visitors, as well as for the operators and for those who must proceed with the transfer operations”.
