Torre del Greco, man stabbed to death at amusement park: sentence reduction for murderers

Sentence reduction in the Court of Appeal for the two boys accused of the murder of John Guarino, the young man not even 19 years old stabbed to death on Palm Sunday evening last year outside an amusement park in the Leopardi district of Greek's tower.

This was learned from the defense of the sixteen-year-olds already sentenced in the first instance, led byAttorney Mauro PorcelliThe Neapolitan judges, after more than three hours of Council chamber, have reformed the contested sentence, reducing the sentence to two years and eight months of imprisonment, applying a total penalty ofmurder and for the other crimes contested, twelve years of imprisonment.

During the trial, the defense of the two defendants insisted instead on accepting the grounds for appeal and, in particular, on the full acquittal of both defendants. Lawyer Porcelli in particular "highlighted - as he himself recalls – retracing the long and complex appeal presented, – all the inconsistencies and contradictions that emerged and the complete absence of elements to support the judgment of conviction of the minors.

Furthermore, both boys have once again professed their innocence, loudly reiterating that they had been unjustly convicted." “This result – adds the lawyer – is the confirmation of what the defense of the minors has always maintained: this proceeding does not have a peaceful outcome, because there is no certain proof of the responsibility of the two boys.

The doubts about the actual course of events are too many and insurmountable and the statements of the subjects present (many of whom were heard with the defense investigations) do not clarify the dynamics of what happened. Precisely for these reasons both the investigating judge, in the first instance, and the Court of Appeal, have shown in their respective decisions all the difficulty of arriving at a clear judgment of conviction”.

”The defense of minors – concludes the lawyer Mauro Porcelli – eagerly awaits the filing of the appeal sentence against which an appeal will certainly be lodged with the Supreme Court, since the final objective to be achieved is the full declaration of innocence of the two minors and their full acquittal”.
