The two prison police officers, Angelo Di Costanzo and Vittorio Vinciguerra, who were accused in the trial held with an abbreviated procedure for the beatings of prisoners that took place in the prison of Santa Maria Capua Vetere on 6 April 2020.
The decision was made by preliminary hearing judge Pasquale D'Angelo, who gave the case ninety days to provide reasons.
The two police officers were the only ones to choose the fast-track trial, an alternative to the trial that allows for a reduced sentence in the event of a conviction but, concluding directly in the preliminary hearing, does not allow for the acquisition of new evidence and is based only on that gathered during the investigation.

Their position was, in fact, marginal and did not appear in internal prison videos. Another 105 defendants, including officers, officials from the Department of Penitentiary Administration (DAP), and local health authorities (ASL) doctors, are currently facing trial under the ordinary procedure, which is taking place in the bunker courtroom of the Santa Maria Capua Vetere prison. Di Costanzo and Vinciguerra were charged with assault, abuse of authority, and torture. Vinciguerra's torture charge was related to an incident that occurred on March 10, 2020, almost a month before the beatings.
During the closing speech held in February, the prosecutors of Santa Maria Capua Vetere (Alessandro Milita, Daniela Pannone and Alessandra Pinto) had requested six years of imprisonment for officer Di Costanzo and three years and eight months for Vinciguerra.
Dozens of prisoners who were victims of the beatings and the Ministry of Justice, which also appeared as civil parties, had filed a lawsuit against the two officers.
