"Spalletti deserves the national team bench for his results and professionalism, he is the most worthy and suitable figure at this time. However, you cannot sign a conciliation report on July 18, 2023 and then call everything into question again after less than 30 days. It is precisely that agreement signed and shared by all that allowed Spalletti to be free, so he must be recognized in full and not in part.

After almost a week of rumors, Spalletti has still not called and asked for a meeting with De Laurentiis or with Calcio Napoli. Neither him nor his lawyers.

And this should make us think. Respect for the rules is fundamental, the basis of any subject”.

Mattia Grassani, lawyer for SSC Napoli, said this on Radio Punto Nuovo, during Punto Nuovo Sport Show.

“I categorically exclude that De Laurentiis is asking for this clause to be respected just for the sake of keeping Spalletti and to impose his own diktat. De Laurentiis and Napoli Calcio would have liked to continue their relationship with the coach who brought the Scudetto back.

Spalletti wanted to interrupt him in any way, so holding him back was impossible. De Laurentiis only moved to protect the respectability of Napoli Calcio.

The 3 million euros do not move anything, we repeat. Contracts must be respected even when someone wants to break them and in that case there is a need for protection such as the clause”, adds Grassani.

“Luciano Spalletti’s clause with Napoli is not such a simple matter.

It is something that came at the end of the negotiation of a seven-page document, shared and signed by Spalletti, Napoli and the lawyers of both parties. Napoli has renounced asking for damages from Spalletti for the early termination of his contract and the coach, for his part, has committed not to carry out any technical activity during the 2023-2024 season.

And this applies to any club or national team. Napoli had to protect itself from this commitment with financial compensation, in the event of a change or failure to respect the agreement by the coach.

Therefore, there is no anti-competitive clause or one that is only valid for clubs, there is no difference between clubs or national teams".

“I understand the position of the other Italian clubs, who would not want public money paid into Napoli's coffers - the lawyer of the blue club continues on Radio Punto Nuovo -. The Federation belongs to everyone, but the FIGC has nothing to do with this affair and has no role from a legal point of view.

Only through a third party or a sponsor could he legally pay the compensation, or through Luciano Spalletti himself. There is a problem.

The Federation manages everyone's money and it would raise more than a few doubts if the clause amount were paid differently. Contracts must be respected even when someone wants to break them and in that case there is a need for protection such as the clause". "Do I fear political friction between De Laurentiis, Napoli and the FIGC?

The Federation is currently only a privileged spectator, remaining on the sidelines to see what happens between Calcio Napoli and Luciano Spalletti. Rather, we must ask ourselves whether the scenario of Spalletti as CT of the National team, who issues the first call-ups of his cycle, while a legal proceeding is underway with Calcio Napoli, will be credible to the public.

This is the most important issue to address. Whoever coaches the national team must not have legal ramifications or ongoing disputes with any club, but must have an equal relationship with everyone.

Otherwise, it would open up to exploitation that would not be good for the national team, at such a decisive moment", concludes the Napoli lawyer.
