Casola, illegal warehouse demolished

As part of the activity to combat the phenomenon of illegal building, which is one of the priorities of the action of this Public Prosecutor's Office, in execution of a demolition order issued by the Court of Torre Annunziata, a sheet metal shed was demolished, with a total surface area of ​​approximately 95 mXNUMX.

The shed was complete and finished in every aspect, equipped with an electrical and lighting system, as well as the demolition of a small space used as a bathroom, adjacent to the shed, with a total surface area of ​​approximately 5 m1, equipped with a water loading and unloading system, as well as the electrical system.

The demolished building was located in the municipality of Casola di Napoli, in the Monticelli, Il Traversa area and the area on which the illegal construction had been built falls within Zone E “normal agriculture”, pursuant to the P.

RG approved with DPAP n. 385 of 02.05.2006 and in the Homogeneous Territorial Zone called "Citta Campagna - Areas with a predominantly residential function" pursuant to the PUC adopted with resolution of the Extraordinary Commissioner n. 4 of 28/11/2018 and in "Territorial Zone 4 for 1st degree settlement and environmental redevelopment" pursuant to PUTLR n.35/1987.

The entire municipal territory is subject to landscape protection pursuant to Legislative Decree no. 42/2004 and falls within the PUT of the Sorrento-Amalfi area approved with LR no. 35/1987. It is also declared to be of archaeological interest and falls within the perimeter of the Central Campania Basin Authority and is declared seismic pursuant to the laws in force on the matter.

The execution of demolitions of illegal buildings ordered by the Judicial Authority represents, for the protection of the territory, an irreplaceable instrument both in a depressive key, for the restoration of the violated environmental conditions, and in a preventive key, for the dissuasive effectiveness against illegal building; in this case, a conviction relating to a sentence dating back to the year 2008 was executed.

Thanks also to the incessant awareness-raising work carried out by this Office, the aforementioned demolition is the umpteenth that has taken place by the owner of the illegal building, under a self-demolition regime, without advance payment of expenses by the Municipality concerned and the Cassa Depositi e Prestiti.
