The Carabinieri of the Investigative Nucleus of the Provincial Command of Benevento and of the Montesarchio Company have executed a personal and real precautionary measure, issued by the investigating judge of Benevento against three suspects.
One in prison, another under house arrest and the third recipient of a provision of obligation to report to the Judicial Police. The three must answer for disturbed freedom of auctions and fraudulent transfer of values.
The investigations, based on information, acquisition of copious documentation, observation, control and shadowing activities, telephone and environmental interceptions, examination of telephone records and images from cameras, have shown how the mayor of a municipality in the Valle Caudina, who is under house arrest, rigged the tender for the safety and hydraulic-forestry works of a road, thanks to the complicity of a traffic policeman who was a member of the tender commission, recipient of the obligation to appear.
In this way, the tender was won by the company whose owner had done small road maintenance works for free and as a 'favor' to please the mayor's electorate.
The tender procedure "for the assignment of the integrated reception service for unaccompanied foreign minors" was also supposed to go to a temporary association of companies promoted personally by the mayor.
The mayor, even before the publication of the tender, had also identified the property to be used for the reception of minors, even though he knew that the premises were not yet suitable for receiving guests, and had chosen the social cooperative that should have won the aforementioned tender, inserting it into the Ati of which he had personally chosen the participants.
The award did not take place solely due to a technical difficulty encountered by the Ati in entering the application into the Mepa system. The procedure for "assigning the service of collection, transport, recovery and disposal of urban and similar waste" of the Municipality, then, in March 2022 went to the company that was already the assignee of the service, in violation of the rotation principle.
The company was the only economic operator to respond to the Municipality's request for negotiation and was awarded the tender for a period of two years, coinciding with the end of the mayor's mandate, effectively lowering the amount set as the basis for the tender and therefore allowing a negotiated procedure to be carried out with the invitation of at least 5 operators.
Furthermore, in order to obtain the award, the legal representative of the company, already subjected to preventive seizure and judicial administration in another proceeding, failed to indicate this condition in the application to participate in the tender and for this reason he is now in prison. The man must also answer for fraudulent transfer of assets, having attributed the formal ownership of the company shares of a company to two front men.
The company is now under seizure, including corporate assets, capital goods, movable and immovable property registered to it. As part of the same proceeding, numerous searches have been carried out and 10 other people are also under investigation for the same crimes and will be questioned in the coming days.
