The investigating judge Cassano of the Court of Avellino, accepting the objection of the lawyers Vittorio Fucci and Domenico Cioffi, deemed the arrest in flagrante delicto carried out by the Cervinara Police against Massimo Passariello to be illegitimate.
The 36-year-old convict from Cervinara was accused of attempted voluntary homicide, since he had doused his neighbor with flammable liquid and then set him on fire following an argument.
The investigating judge, therefore, ordered his release. However, due to the seriousness of the fact, he decided to issue a precautionary custody order to keep Passariello in prison, pending the developments of the investigation.
The defense, in addition to the investigative activity that it will carry out from the point of view of the exculpatory elements, will appeal the new order to the Review Court of Naples.
