After the 2011 local elections in Villa Literno, Despite his position as head of the municipal technical office, Antonio Fabozzi was transferred to a cramped space, without a desk or computer, and above all without any tasks or duties to carry out.
More than ten years later, a court recognized that Fabozzi was the victim of mobbing, or persecutory and harassing behavior, and ordered the municipal body to compensate him for damages quantified at 30 thousand euros.
The case concerns the former head of the UTC, Antonio Fabozzi, currently head of the Building Abuse Office, also in Villa Literno. Fabozzi turned to the labor court in 2017, assisted by the lawyer Pasquale Marotta, obtaining a favorable ruling from the court of Napoli North, chaired by judge Stefania Coppa.
Fabozzi's problems began after the 2011 municipal elections, when Nicola Tamburino was elected mayor, remaining in office for two terms until 2021. Fabozzi was immediately demoted, with the Municipality assigning the management position of the entire technical area to an outsider, merging the urban planning and construction sector into a single area.
Fabozzi appealed and was transferred again to the technical area, but in a narrow and unhealthy space, without a desk, chair or computer, without specific tasks and with the only generic indication to “collaborate”.
Furthermore, he was denied permission to obtain the position of urban planning manager at the Municipality of Alife, in the Alto Casertano area, which would have guaranteed duties consistent with his skills. All these conducts were considered mobbing by the judge, who condemned the Municipality of Villa Literno.
