The first phase of the preliminary hearing against bariatric surgeon Stefano Cristiano was held today before the Judge for Preliminary Investigations of the Court of S. Maria Capua Vetere, Dr. Daniela Vecchiarelli.
This follows the request for referral to trial of the Chief Prosecutor of the Republic Dr. Pier Paolo Bruni and of the Public Prosecutor delegated to the investigations, Dr. Valentina Santoro. The hearing held against the surgeon was a long one Stefano Cristiano ( in his new role as defendant ).
First there was the civil action brought by Angela Iannotta (with the lawyer Raffaele G. Crisileo) and the relatives of the deceased Francesco Di Vilio (with the lawyer Gaetano Crisileo) and then that of theAssociation “Codes” with the lawyer Ivano Giacomelli.
The novelty of today's hearing is represented by the request for summons to court - as a civilly responsible party - of the Villa del Sole Clinic SpA di Caserta in the person of the health director of the facility Dr. Nicolino Rosato and his legal representative pt Dr. Amerigo Porfidia by the Crisileo lawyers according to whom it is the clinic that must compensate damages to Angela Iannotta and the Di Vilio heirs for the charges brought against Dr. Cristiano, in the event he is convicted: among the charges brought against the professional are those of very serious negligent injuries and forgery against Angela Iannotta and of manslaughter for the death of Francesco Di Vilio.

The situation of the Villa del Sole Clinic, where both surgeries were performed, is still uncertain as the Preliminary Hearing Judge today reserved the right to decide on the request made by the lawyers Crisileo respectively for Iannotta Angela, in her own right and for Di Vilio Salvatore, son and heir of the deceased Francesco and Di Vilio Anna, sister and heir of the deceased Francesco.
For the record, both Angela Iannotta and Francesco Di Vilio developed a serious form of septicemia after surgery and the clinic structure was not equipped with a resuscitation unit and suitable equipment to provide assistance to the two patients. This was ascertained by the expert panel appointed by the PM headed by Prof. Gaetano Buonocore and by joint inspections by a panel of 6 medical specialists ordered by the ASL.
