Frattamaggiore, complaint to the Prosecutor's Office for the illegal occupation of public spaces

Frattamaggiore. Illegal occupation of public spaces in Piazza Pezzullo and Corso Durante: exasperated citizens write to the Public Prosecutor Naples, Nicola Gratteri.

A long and detailed complaint in the form of a popular action, given the alleged inertia of the municipality and with a substantial photographic report at the bottom, was sent directly to the Attorney Gratteri's menu.

In the complaint, also addressed to the Public Prosecutor's Office Napoli Nord, to the Prefect Michael of Bari, to the Guardia di Finanza Group of Frattamaggiore, to the mayor Marco Antonio Del Prete, to the Manager Domenico Raimo, to the Councilor Michael Granata and to the Commander of the Municipal Police Francesco Romano, have requested the application and compliance with the Regulation for the discipline of the occupation of public spaces and areas.

In the long and full-bodied dossier, about fifty people from Fratte have highlighted how the Municipal Regulation certifies that occupations of any nature are subject to the obligation of prior authorization or municipal concession issued by the competent Office of the Economy and Labour Policy Area, following a documented request from a person authorised to do so.

And also how the occupations of public spaces with goods for retail sale are not included among occasional occupations, and that in the event of unlawful occupation the Municipal Administration, following a complaint, must order the removal of the materials and the restoration of the state of the premises, providing for this ex officio and at the expense of the offender in the event of inertia on the part of the latter (art. 7 paragraph 2 of the latest regulation cited).

“All this being said - the undersigned write - it is reported that, starting from the Christmas holidays period, the illegal activities have continued". All the signatories – it reads – “they constitute themselves as direct witnesses of the reported factual circumstances” and, in this case, “we are not aware of any prohibitive measures by the local authorities and therefore, to date, the reported situations of illegality persist”.

The complainants also request to order the immediate removal of the materials from the sites, where the 48-hour term starting from the notification of the violations has expired, providing for the expense of the offender in the event of inertia of the latter. And, where the Municipality has not proceeded to formalize any notification, proceed with all speed to the initiation of the procedure”.

According to the signatories of the complaint, it would be “beyond any doubt that, in the case in question, the illegitimate occupations pursue a private interest that expires once the commercial period coinciding with the Christmas holidays has passed; therefore, the situation of illegality reported continues”. For this purpose - they write again - “they want to urgently conduct the necessary Judicial Police investigations”. In the meantime, the activities would continue even as Epiphany approaches and beyond.
