The legal proceedings against Francesco Pio Valda, alleged murderer of Francesco Pio Maimone, young aspiring pizza chef killed during a clash between rival gangs in Naples in the chalet area of Mergellina, has been set for February 27 at the first section of the Assize Court of Naples.
Valda, 23 years old, is accused of being the material executor of the murder that took place on the promenade of Naples night between March 19th and 20th of last year. The prosecution claims that Valda fired a bullet into Maimone's chest during a clash between youth gangs, even though the victim had no involvement in the incident.
The request to set the trial date was accepted this morning by the investigating judge Chiara Bardi, on the initiative of the Anti-Mafia prosecutor Antonella Fratello, who had coordinated the investigation together with her colleagues Claudio Orazio Onorati and Simona Rossi.
Six other people, including Valda's friends and family, will also be involved in the trial, accused of complicity in the escape and the disappearance of the gun used and the dirty shoes. The origin of the gang clash appears to be linked to a previous episode in which Valda allegedly received a stomp, thus staining a couple of branded shoes. This episode would have triggered a violent reaction and a shooting among the people present in the chalets of Chiaia, with Maimone as the involuntary victim.
Alessandra Clemente's defense claims to be uninvolved in the affair
During the hearing, the request for a summary trial presented by the lawyers of Valda and Alessandra Clemente, accused of having delivered the weapon to Valda, was rejected. The latter's lawyers maintain that an expert examination of the footage could exonerate her from the charges. The civil parties in the trial are: Maimone family, the Municipality of Napoli and the Polis Foundation.
