The continuation of the state of agitation by Sapna employees who do not allow the dumping of waste in the waste disposal plant Tufino, is creating significant inconvenience for the municipalities of Ato Na3 who find themselves having to deal with what could become a real emergency.
The Mayors of Ato Na3 condemn the forms of protest that go beyond the legitimate prerogatives of the unions and that are disrespectful towards the citizens, as they generate health and hygiene problems, given the impossibility of collecting the other fractions already delivered. A situation that, precisely because of these risks, has also been represented to the Prefecture.
We do not agree with the reasons given by the trade unions, which are clearly in contrast with the relevant regulatory provisions, and which also hypothesize possible repercussions on employment levels, which are completely unfounded.
The mayors' will is in fact that of the valorization and expansion of the sector, also in relation to the entry into operation of the other plants serving the Ato that are under construction.
It is not the intention of the 59 municipalities belonging to the Ato to split up the current perimeter of competence of the former provincial companies, but in the legitimate exercise of decision-making power - as set out in the law - it has evaluated and approved a management model that guarantees prevailing public control for a segment of the integrated service that is absolutely strategic.
As established in the resolution, a comparison process will be activated with the other two Atos belonging to the province of Naples to verify the possibilities of sharing a unitary process.
The Atos have attempted in the recent past to acquire the shares of Sapna, the current manager of the service owned by the Metropolitan City of Naples, but first the Court of Auditors and then the AGCM (Italian Competition and Market Authority) have heavily criticized the acquisition, emphasizing the uncertain economic and patrimonial sustainability of the company and even opening a proceeding to evaluate any possible treasury responsibilities on the procedures adopted.
Elements that with the entry into force of Legislative Decree 201/2022, which establishes that only municipalities can hold shares in public companies and no longer Atos, have determined a choice of responsibility that still provides for a newco with prevalent public control and capital.
The members of the Council of the Area are available to meet with the trade unions, in order to clarify the legitimate positions taken with the contested resolutions, which - it must be firmly clarified - cannot be the object of what appear to be undue and unjustified interferences.
