Naples, unlawful dismissal: the Court of Appeal reinstates 5 Catone transport workers

Five workers of Catone Trasporti srl, members of Flai-Cgil, have been reinstated by the judge of the Labour section of the Court of Appeal of Napoli.

The workers had been fired for just cause "for having worked a shift other than the one arranged" by the employer. Flai-CGIL, through its lawyer Raffaele Ferrara, challenged the ruling, arguing that the dismissals were unlawful because they were retaliatory for the workers' strike against the failure to recognize the supplementary contract.

The judge ruled in favor of the workers, declaring the dismissals unlawful and ordering the company to pay each worker 12 months' salary in compensation.

The ruling sets an important precedent and warns employers against failing to comply with relevant national collective agreements.
