The Regional Administrative Court of Campania today issued a single-judge precautionary order rejecting the appeal filed by Juve Stabia against the order of the Prefect of Naples. The Prefect had ordered the Juve Stabia-Taranto match, scheduled for this evening at the Menti Stadium in Castellammare di Stabia, to be played behind closed doors for public order reasons.
Juve Stabia had submitted the request in the hope of obtaining an exception to the Prefect's order, but the request was denied, confirming the need to adopt extraordinary precautions to preserve public order. The primary reason behind the decision to play the match behind closed doors was safety and security concerns, especially given the context and the events that could occur during the football match.
The Prefect of Naples, in issuing the contested order, deemed it the best measure to ensure the safety and well-being of all spectators and staff involved. Juve Stabia, while expressing its opposition to playing the match behind closed doors, will have to comply with the Campania Regional Administrative Court's decision.
The TAR: "there is a prevailing interest in public safety"
According to Maria Abbruzzese, President of the Fifth Section of the Regional Administrative Court of Campania, the decision to reject Juve Stabia's appeal against the closed-door match against Taranto is motivated by the lack of conditions for granting the requested precautionary measure. The President stated that the public interest in the safety of sporting events prevails, as evidenced by the opinion of the Provincial Committee for Public Order and Safety.
The Committee's opinion emphasized the risk of harmful events, citing recent incidents, particularly after the match between Juve Stabia and Casertana on March 4. On that occasion, there were breaches of security cordons, the throwing of blunt objects, attacks on vehicles belonging to the visiting team's fans, and injuries sustained by members of the police force, some of which were attributable to fans of the complainant team.
The president also emphasized that the damage alleged by Juve Stabia is primarily financial in nature and, therefore, not irreparable. The decision of the Campania Regional Administrative Court reflects the priority given to safety and the prevention of risky situations during sporting events, emphasizing the importance of ensuring a peaceful and protected environment for all participants at football events.
