False appeals against telephone operators: the Court of Cassation annuls the decision of the Review for the lawyer of Airola.

The Fifth Criminal Section of the Supreme Court of Cassation, accepting the appeal of the lawyer Vittorio Fucci, has annulled the provision of the Court of Appeal of Naples which ordered the precautionary measure of suspension from the practice of the profession for the lawyer MD of Airola, accused of organizing a criminal association and forgery.

A new review hearing before another Section was ordered. The Fifth Section of the Court of Cassation examined exclusively, in the hearing held, the position of the Airola lawyer.

Previously, the United Sections of the Supreme Court had been entrusted with the question relating to the usability of the wiretaps which would constitute the evidentiary basis against all the defendants in the proceedings.

The Joint Sections had already issued, regarding wiretaps, a sentence which provides that wiretaps cannot be used.

The proceedings arose following an investigation involving 11 people, including several professionals, who, according to the prosecution, allegedly filed a multitude of false appeals, subsequently misleading the Judicial Authority.
