The Court of Cassation rejected the appeal presented by the defense of Gina Pompeo Faraonio, CEO of the company that manages the Cinema San Marco in Benevento, confirming the sentence of 6 months in prison and the payment of damages to the civil parties.
Faraonio had been charged with negligently causing serious injury to several students at the Sannio High School. Carbon monoxide emissions, caused by a malfunctioning boiler-flue system, had caused the poisoning of several students during the Second Sannio Philosophical Festival, held at the San Marco Cinema in February 2016.
In the first instance, the Court of Benevento had acquitted Faraonio.

La Supreme Court deemed the defense's appeal inadmissible, confirming the sentence of 6 months in prison and the compensation for damages. Faraonio will also have to reimburse the legal costs incurred by the civil parties.
