A 54-year-old Carabinieri officer, originally from the province of Naples, who was then serving in Ravenna and later transferred, was initially sentenced to 11 months for fraud and forgery for having had sexual intercourse with a woman in the barracks during duty hours.
However, the Bologna Court of Appeal acquitted him with various formulas, including "due to the particularly trivial nature of the act" and "because the act did not exist," accepting the requests of his lawyer Enrico Ferri.
The facts date back to 2017
The incident dates back to the night between January 10 and 11, 2017. The Carabiniere, a select corporal originally from the province of Naples, entered the Ravenna provincial headquarters with two women, telling the guard he had a job to do. In reality, he had secluded himself in the office with one of the women, under the eyes of the other.
For this reason, he was sentenced in the first instance to 11 months for fraud, related to one hour of undue overtime (€15,85), and for false statements made to his colleague. He was also ordered to lose his rank through dismissal.
The turning point on appeal
However, the Bologna Court of Appeal overturned the sentence, acquitting the Carabiniere. The reasons were varied: in some cases, the act was not considered a crime, in others, the particularly trivial nature of the offense was recognized. Furthermore, the Court revoked the accessory penalty of loss of rank.
The complaint for sexual violence
The story only emerged in November 2017, when the woman, a 40-year-old foreigner, returned to the barracks to report the carabiniere for sexual violence.
The woman was convicted of slander: the relationship was consensual
A version however denied by the friend present at the intercourse, who claimed that the woman had consented and had taken the initiative herself.
For this reason, the woman was in turn sentenced in the first instance to one year and four months for slander. This sentence is now awaiting appeal.
