Casapulla farmer on trial for death of employee

Request for indictment signed by the Public Prosecutor of the Court of Santa Maria Capua Vetere, Dr. Daniela Pannone, for the agricultural entrepreneur D'Angelo Aniello, 62 years old from Casapulla.

According to the charges, in his capacity as employer, through his negligence consisting in the failure to comply with the regulations for the prevention of accidents in the workplace, he caused the death of one of his agricultural workers, Salvatore Ferraro. For this reason, he is charged with manslaughter due to an accident at work, in the aggravated form.

According to investigations carried out by the competent Carabinieri station, the deceased worker Ferraro Salvatore had not been regularly employed and lost his life while picking cherries in an orchard owned by D'Angelo Aniello in Castel di Sasso. While he was busy handling a six-metre-long aluminium ladder, positioning it and climbing onto it, he hit the ladder against the electrical cables that were in the orchard and hanging over him.

For these reasons, he was electrocuted and lost his life because the ladder acted as an electrical conductor with the high voltage wires. The rescue efforts were useless and could do nothing but confirm his death.

The Public Prosecutor's Office also charged D'Angelo Aniello, represented by lawyers Raffaele and Gaetano Crisileo, with violating workplace safety regulations because, as the poor worker's employer, he failed to take into account his work ability and health and safety when assigning him tasks, nor did he subject him to a medical examination to ensure his health and fitness for the agricultural worker's duties.

Finally, the deceased worker Ferraro Salvatore, as contested by the PM, had not been trained and informed about the risks of his job and the place where he worked, at the time of his death, or about how to use the aluminum ladder safely and about the electrical risks he could incur, nor had he been given the necessary and suitable protection and prevention devices.

Tuesday 2 July the preliminary hearing has been set before the Judge of the Sammaritan Court Dr. Gaudiano in which the wife and children of the deceased Ferraro Salvatore will join the civil action, assisted by the lawyer Alfonso Iovino.
