Naples. The Supreme Court of Cassation agrees with the CGIL and establishes the right to recognition of the “3rd level” for waste disposal operators who provide services by driving compacting or ramming vehicles, more commonly known as “gasoloni”.
The Court of Cassation on 04 June 2024 ruled by rejecting the appeal filed by ASIA Napoli, against the ruling of the Court of Appeal of Naples which, following the dispute brought by Fp Cgil with the legal assistance of the well-known lawyer Antonio Panico, recognized the worker's right to obtain the 3rd contractual level.
“Although it had been invited in the past to respect the CCNL recognizing that workers involved in driving vehicles with a compaction or tamping system have the right to be classified in the 3rd Level, Asia Naples preferred to continue for twelve years in the courtrooms – Alfredo Garzi and Maria Manocchio of FP CGIL Naples specified – thus arriving at today's date with a ruling by the Court of Cassation which also means the remuneration of the economic differences due to the workers who have appealed to the court starting from July 2007”.
“The FP Cgil of Naples, claiming the action taken by holding firm to the bar of law without compromising, thanks the workers who in these years have not given up and have gone all the way, obtaining a result that today with the ruling of the Court of Cassation becomes an enforceable right for all those who intend to start the same action.
The FP CGIL is available to all workers who would like to see their rights recognized on a par with their victorious colleagues".
