Naples. Justice has been served for a 50-year-old man who died from infections contracted at Cardarelli Hospital in Naples. The Court of Naples has acknowledged the hospital's serious liability and issued a compensation judgment of over €400.000 to the patient's family.
A dramatic case from two years ago. Following a fall at home, the man went to Cardarelli Hospital for a fractured femur. After surgery, he was transferred to a rehabilitation center, but his condition rapidly deteriorated, requiring him to be readmitted to the hospital.
Within a short time, the patient had developed severe symptoms, including difficulty breathing, tachycardia and abdominal pain, followed by a progressive deterioration of his condition.
Medical tests revealed the presence of multiple severe infections, including Klebsiella Pneumoniae, Acinetobacter Baumannii, Escherichia Coli, and Candida Albicans, which caused a severe systemic imbalance, involving the liver and kidneys, and ultimately septic shock resulting in death from heart failure.
Maior Associates, represented by attorneys Pierlorenzo Catalano, Michele Francesco Sorrentino, and Filippo Castaldo, with the support of medical examiner Dr. Marcello Lorello, has been following the case from the beginning.
Through an appeal for preventive technical assessment (ATP) and a subsequent ordinary appeal, the firm demonstrated that the infections contracted in hospital were the primary cause of death and that Cardarelli had not adopted all the necessary hygiene and health measures to prevent them.
According to the Court, at Cardarelli not all the necessary hygienic-sanitary measures had been respected
The Court accepted the requests of Studio Maior and recognized the patient's family members a compensation of over 400.000 euros. "This finding is an important step forward in the fight for justice in medical malpractice cases," declare the lawyers of Studio Maior. "We are proud to have continued this fight and to have obtained fair compensation for our client's family."
