The 9-year, 6-month prison sentence for Michele Antonio Gaglione, responsible for the death of his sister Paola Gaglione, has become definitive.

He is charged with unintentional homicide and the Court of Cassation rejected the appeal presented by his lawyer.
On the night between September 11 and 12, 2020, the girl was on a scooter with her trans partner Ciro Migliore. The two were chased by Michele Antonio Maglkione who opposed his sister's relationship with Ciro.
The scooter with the two boys on it went off the road due to a rear-end collision with her brother and Paola lost her life because she crashed head-first into an irrigation pipe that was on the ground adjacent to the road.

Gaglione was also sentenced to pay damages
The court also sentenced the defendant to pay damages to the civil parties, namely Ciro Migliore and the association Antinoo Arcigay Napoli, recognizing the transphobic motive in the murder.
Antinoo Arcigay Napoli has contributed to the achievement of this important result for the memory of Maria Paola and will work to obtain compensation for the damage. The proceeds will be used to continue the fight against all types of discrimination and violence based on homosexual, lesbian, and transphobia”.
