Caivano. MGROUP, the owner of the land on which the new Caivano municipal stadium is planned to be built, has announced it will appeal to the Regional Administrative Court (TAR) against the expropriation order issued by the Municipality for the construction work.
According to MGROUP, the acquisition of the land by the Municipality would have occurred with "errors" and would be based on a "a legal matter that has been going on for 23 years."
MGROUP also disputes the Municipality's claim that the land was confiscated from the Camorra, arguing that "it would not appear among the assets confiscated from the Camorra."
23-Year Legal Battle
The company highlights that it has been involved "for 23 years" in a "Legal battle to demonstrate the senselessness and non-existence of an administrative provision that has been challenged several times since the administrative proceedings began."
The company asks the TAR to "review the land acquisition documents by the Municipality."The announcement of the appeal to the TAR was made during a press conference organized by MGROUP, attended by the company's administrator, Francesco Moccia, and lawyer Sergio Clemente.
We are now waiting for the TAR's decision on the appeal presented by MGROUP. The case could have a significant impact on the project to build the new municipal stadium in Caivano.
Commissioner Dispenza, land for Caivano stadium acquired after building abuses
The coordinator of the Extraordinary commission who governs the Municipality of Caivano, prefect Filippo Dispenza, specifies in a note that the land on which the Caivano Municipal Stadium will be built "It is a property that was acquired, pursuant to art. 31 of Presidential Decree 380/2001, by the Municipality of Caivano from the MGROUP Company, the owner at the time, and not from the Moccia clan, following illegal building by that Company on that area."
