The Naples Court of Appeal issued a landmark ruling, ordering former senator and mayor of Afragola, Vincenzo Nespoli, to pay over €16 million in damages to the bankruptcy trustee of the security company "La Gazzella Srl."
The decision, which also includes the payment of legal costs at both levels of the trial, ends a long legal dispute that began almost twenty years ago.
The investigation, which involved Nespoli as director of the company, focused on the causes of the bankruptcy of “La Gazzella Srl”.
Investigators have speculated that the former politician mismanaged the company's resources, contributing to its financial collapse.
The sentence
The Court of Appeal, accepting the requests of the bankruptcy trustee, considered Nespoli's civil liability towards the company's creditors proven. The ruling, in addition to quantifying the damages, also ordered the former senator to pay the legal costs incurred by the civil parties during the long trial process.
Lawyer Luigi Imperlino, defender of Nespoli, had contested the charges, maintaining that his client had no involvement in the causes of the bankruptcy. Despite a strenuous defense, the Tribunal and, subsequently, the Court of Appeal rejected the defense arguments, confirming Nespoli's civil liability.
Defense attorney Luigi Imperlino managed to significantly reduce the initial request, but the ruling still represents an important turning point in the proceedings.
The consequences
The conviction represents a hard blow for the former senator, already involved in other judicial investigations.
