Patrizio Bosti, due to a calculation error in determining the cumulative sentence, was released from prison on May 11, 2020.

He spent 5 days at liberty, before being arrested again on May 16th.
2020. At this juncture, having returned to Naples, he immediately took over the reins of the clan, as attested by the wiretaps, and immediately summoned his most trusted acolytes.

On that same date he assigned the role of his “new” lieutenant to Migliaccio Antonio, son of the more well-known Migliaccio Giovanni, affiliated with the Contini clan and at the time in prison.

All this emerges from the conversations intercepted on the user account used in Oliva
Annunziata, mother of Migliaccio Antonio, as well as from the wiretaps recorded in prison during conversations between the prisoner Giovanni Migliaccio and his family.

 Antonio Migliaccio's investiture as boss

The conversations are contained in the almost 900 pages of the precautionary order, signed by the investigating judge Antonio Santoro, which hit the boss Patrizio Bosti himself on the eve of a new and imminent release from prison, his children Ettore and Flora and his son-in-law Luca Esposito.

On that date, in fact, Bosti decided on a total reversal of the association's strategic lines, which until then had been based on a substantial mafia peace with the opposing Mazzarella cartel, summoning a leading member of the latter group, Salvatore Barile, known as Totoriello, with the intention - which emerged approximately 2 years later from the wiretaps carried out at Ciro Mazzarella's house - of killing him.

All this without the knowledge of the then regents of the clan, namely Botta Carmine and De Luca Gennaro, whose management he evidently did not share, so much so that Bosti, once back on the territory, did not summon him before him, thus confirming the hypothesis that he wanted to invest Migliaccio Antonio with the role of his lieutenant.

It is likely that the basis of this strategic choice was the discontent of the boss Patrizio Bosti regarding the management of the clan's coffers: and in fact, as will emerge from the conversations following his subsequent arrest and from Luca Esposito's declarations, he had found a "hole" in the clan's coffers of several million euros.

Bosti also inquired about the management of territories historically under the control
of the Secondigliano Alliance, like Giugliano in Campania, where it has been for years
hegemonic the Mallardo clan, confederated in the criminal cartel. The investigating judge also writes this: “This can be deduced from the wiretaps carried out at the home of Lìcciardi Maria, (at the time still free and at the top of the Licciardi clan) from which it emerged that, in the short period of freedom, Patrizio Bosti had met Comite Oreste, affiliated with the Mallardo clan, to be informed about the current criminal situation in Giugliano and that, at that meeting, Bosti had acknowledged Comite's full involvement in the association (“He said “o Mellò …incomp… he said “You are the family, OK?” . (ed. In a low voice)…”.

Then, again at the request of Patrizio Bosti , Oreste Comite had arranged a meeting with Amicone Giuliano, then regent of the Mallardo clan, presumably to find out about its management, a meeting which, however, did not take place following Bosti's new arrest.

The immediate response of his companions to his "summons", the fibrillation
recorded in telephone conversations for his return to Naples, the investiture, in the context of a new strategy, of Migliaccio Antonio as his lieutenant, the concern aroused among his adversaries of the Mazzarella clan for the imminent definitive release from prison, at the time scheduled for the end of June 2022.

There are environmental conversations in the records between Barile Salvatore and Mazzarella Ciro, in which, having sensed Bosti Patrizio's desire to kill the former, the two prepared for the "war" with the Secondigliano Alliance, reviewing the affiliates to be involved and taking stock of the current structure of the criminal cartel and the possibility of obtaining weapons), the interest shown in the criminal structures in the relevant territory, in Naples and in the province,

And the investigating judge writes: “These fibrillations unequivocally indicate that Patrizio Bosti is, despite his detention under a special regime, still tenaciously at the centre of the Neapolitan criminal scene, that he is still a figure of the highest criminal calibre, capable, if released from prison, of immediately returning to command the cartel he directs”.
