Mario Eutizia, a 48-year-old Neapolitan, will remain in prison after confessing to killing four seriously ill elderly people he had cared for over the past ten years.
This decision was taken by the preliminary investigations judge of the court of Santa Maria Capua Vetere, Alessandra Grammatica.
Although the judge did not validate the arrest warrant issued by the Prosecutor's Office on August 22, deeming there to be no risk of escape—since Eutizia had voluntarily turned himself in to the Carabinieri and confessed to the crimes—a precautionary detention order was issued.
This is because of the risk that, if left free, Eutizia could repeat the crimes.
But for the investigating judge, the Latina court has jurisdiction
The investigating judge declared his territorial incompetence, stating that jurisdiction belongs to the court of Latina, where two of the crimes occurred in 2014, with the others in Casoria and Vibonati. The documents will therefore be sent to Latina for the continuation of the investigations.
Eutizia's lawyers, Antonio Daniele and Gennaro Romano, while evaluating an appeal to the Review Court for release from prison, do not negatively contest the GIP's decision to keep Eutizia in prison, considering the first result satisfactory since the need to justify the detention has ceased to exist.
They have faith in the work of the investigators and await further investigative developments.
The lawyers are asking for him to be transferred to a facility that can offer him adequate care.
Eutizia, in precarious health conditions, an oncology patient and diabetic, could be transferred to an adequate facility to receive the necessary care, with several associations and health facilities ready to welcome him.
The investigation continues to verify Eutizia's statements on the four murders and to examine her past activity as caregivers. Eutizia asked for help to stop killing, fearing that she might repeat the crime if she found herself in similar situations again.
