Gennaro Capodanno, president of the Valori Collinari Committee and former president of the District Vomero, responded harshly to the owners of public establishments who occupied the streets of the Vomero district.
In particular, the pedestrian areas of via Scarlatti and via Luca Giordano, with a series of structures such as outdoor seating, gazebos, umbrellas, tables and chairs, often placed beyond the authorised limits and without an organic arrangement project.
These traders oppose the need to clear the route of the historic solemn procession, which takes place in Vomero in honor of the patron saint every 19 September.
The need to free these areas is linked to the solemn procession of San Gennaro, which takes place on September 19. This procession is a centuries-old tradition that passes through the historic streets of Vomero, touching three churches dedicated to the saint.
Some shopkeepers would like to change the route of the procession, a request that Capodanno considers “absurd as well as unacceptable”.
Capodanno cites two articles of law to support his position:
Art. 27, paragraph 5, of the Highway Code: Allows the revocation of concessions for the occupation of public land for reasons of public interest or road safety without compensation.
Art. 21 quinquies of Law No. 241/90: Allows the revocation of administrative provisions for supervening reasons of public interest.
If the Municipality of Naples does not intervene, Capodanno threatens to ask the Prefect of Naples to intervene. Furthermore, he announces the possibility of filing a complaint-denunciation to the judicial authority.
Capodanno stresses that the procession will still take place, and vendors will have to remove all furnishings to ensure public order and safety during the event.
This dispute reflects a conflict between tradition and commerce, where the law is invoked to protect a cultural and religious event of great importance against commercial expansion that might compromise its realization.
