Scafati. No confiscation and the immediate return of all assets seized from Giulio Cesarano, a funeral director, and his children: this is the decision of the Salerno Court - Preventive Measures Section, filed on September 12, 2024.
According to the Salerno judges, Cesarano is not linked to organized crime and therefore the assets registered in the name of his family members are also legal.
The decision of the last few days follows by a few months the preventive seizure of company shares and agricultural land, which took place in January 2024, against the Cesarano family, resulting from an investigation by the Prosecutor's Office delegated to the Anti-Mafia Investigation Directorate of Salerno.
The seizure measure for the purpose of confiscation concerned shares of company shares, current accounts, real estate and agricultural land registered to the children of Giulio Cesarano which, according to the Prosecutor's Office, were disproportionate to the income of the owners and therefore attributable to the funeral home business involved in a trial by the Neapolitan DDA.
In 2018, the Cesarano company ended up in the crosshairs of the anti-mafia for suspected links with the D'Alessandro Camorra clan of Castellammare di Stabia.
This last very serious accusation was dropped in the trial held at the Torre Annunziata Court and concluded in March 2023 with the definitive acquittal of Giulio Cesarano, the brother Alfonso and the other co-defendants.
On the basis of the criminal proceedings in Naples, the Salerno prosecutor's office had in the meantime promoted a parallel investigation to discover the proceeds of the alleged illicit activity and in January the seizure had arrived, the object of the confiscation procedure defined in recent days, with the restitution of all the assets.
The defense has demonstrated the lawfulness of the assets
In the course of the proceedings, in fact, the defense demonstrated the lawfulness of the assets registered to the suspects and, on the basis of the acquittal without appeal in the Neapolitan criminal proceedings, the judges - president Cristina De Luca, judges Dolores Zarone and Rosaria de Lucia - rejected the request for confiscation and ordered the return to the owners of all the seized assets.
The request made by the Prosecutor's Office also included the preventive measure of special surveillance against Giulio Cesarano, which was also rejected by the judges, as the entrepreneur was found to be unconnected to any criminal context, as established by the Court of Torre Annunziata.
Thus ends a legal affair – which lasted for years – in which the Cesarano funeral home, operating in the Agro Nocera and Stabia area, was involved.
The ruling of the Court of Salerno – prevention measures section – reiterates what Cesarano has always maintained through his defenders of his lack of involvement in any illicit context of his business activity.
The relief of the entrepreneur Giulio Cesarano after years of investigations
Giulio Cesarano, after the positive conclusion of all the proceedings against him, commented with relief on the matter on his social profiles, expressing gratitude towards the judiciary that recognized the correctness of his work and that of his family.
“Let me express my satisfaction and gratitude towards those magistrates who, after years of personal and family suffering, have recognized the correctness of my work and that of my family members”, writes Giulio Cesarano.
And then she adds: “In the many years of daily investigation, no dangerous profile has been found that would have unworthily favored him.
Even the Court of Salerno, after that of Torre Annunziata, has verified and recognized the correctness of all the profiles of my person and those of my loved ones, without finding any stain. I have always had faith in the positive outcome of the case precisely because, the same trust, I have always had towards the Judiciary.
Now we return to living with renewed faith and with the commitment of the past, grateful also to the many friends who have been close to us in these years without ever doubting".
