A 22-year-old man has been cleared of charges of participating in a shooting which took place in May in the Pianura district of Napoli.

Francesco Olgato, arrested a month ago, together with the baby boss Massimiliano Santagata and another accomplice were released from prison thanks to the decision of the Eighth Section of the Naples Review Court, which accepted the request of his lawyer, Antonio Usiello. The judges did not find sufficient evidence of his guilt.
The recognition of Olgato as one of the perpetrators of the attack, during which there were no injuries, proved unreliable. The defense demonstrated that, at the time of the shooting, the attackers were wearing full-face helmets, making it impossible for the victim to identify them with certainty.
Furthermore, the car used in the raid, filmed by the cameras, was similar to Olgato's, but with a different license plate.
Accused of the failed ambush on Luca Battista
Two other suspects remain in prison for the failed ambush, which targeted Luca Battista, a criminal under house arrest: Salvatore Carpentieri, 25, and Massimiliano Santagata, 20. A minor is also under investigation.
The Naples Flying Squad reconstructed that the shots were fired on May 4 in via Torciolano, when Battista managed to escape by hiding in his home. The bullets hit the furniture, but did not injure anyone. One of the suspects was arrested in Calabria at the beginning of August, while he was on vacation.
