The court of Naples, judge Maria Tartaglia Polcini, has filed the reasons for the sentence with which last October 4 it acquitted RL, a forty-seven year old from San Giovanni a Teduccio (defended by lawyers Giuseppe Milazzo and Immacolata Romano), who was charged with possession of 873 kilograms of contraband cigarettes.
The investigations dating back to 2019 had started with the intervention of the Carabinieri of the Napoli Stella Company, who, alerted by an informant, had raided a garage in San Giorgio a Cremano finding the cartons inside a container which were then seized.
During the trial, the two defense attorneys brought to light that at the time of the raid their client was not physically present in the garage nor had any searches been ordered against him.
Therefore, despite the fact that the Carabinieri had acquired the rental contract for the container, duly signed, with the identity card of the accused attached, who is also a well-known criminal with several previous convictions for cigarette smuggling, the defense team strongly instilled doubt and succeeded in its intent.
The judge, therefore, for these same reasons which he explained well, issued a sentence of acquittal for not having committed the crime.
