Appeal trial for the death of little Chiara Mirto

The trial against the pediatrician from Macerata Campania, Dr. Eugenio De Felice, acquitted in the first instance "because the fact does not exist", reaches the appeal stage.

The appeal was promoted by the civil party, represented by the lawyers Gaetano and Raffaele Crisileo.

De Felice is accused of manslaughter for alleged professional negligence in relation to the death of little Chiara Mirto, a four-year-old girl from Macerata Campania, who died during the night between 2 and 3 March 2015 at the Civil Hospital of Caserta due to complications of myocarditis.

The girl's parents initiated criminal proceedings, accusing the doctor of superficiality in two previous visits, on February 27 and March 2, during which, according to the testimony of the mother and grandparents, he limited himself to examining the little girl's throat without listening to her heart and chest, and did not recommend hospitalization, not even during a phone call on the evening of March 2.

Crisileo's lawyers maintain the defendant's guilt, arguing that medical negligence lies precisely in the failure to indicate the hospitalization during the telephone conversation. They also believe that the pediatric visits on February 27 and March 2 were conducted superficially, as stated by the parents and grandparents, who are considered credible witnesses.

According to the civil party, if the doctor had listened to the child's heart and chest and ordered her hospitalization, the little girl would have had a high chance of survival.

Now Chiara's father wants to continue the legal battle, not only in memory of his daughter, but also of his wife Teresa Dell'Aquila, who passed away during the trial at just 39 years old from an incurable disease.
