There was a dramatic turn of events in the 2015 murder of Aldo Autuori in Pontecagnano (Salerno). The Court of Cassation overturned the life sentence handed down to Antonio Tesone, considered one of the perpetrators of the crime, at the request of the Mallardo and Mogavero-Bisogni clans.
The Supreme Court's decision overturns the first- and second-instance rulings, which had convicted Tesone based on wiretaps, statements from collaborators with justice, and analysis of cell phone records. According to the defense, however, the identification of Tesone's voice in the wiretaps was uncertain, a crucial point on which the legal battle focused.
Autuori's murder occurred during a clan feud for control of the territory. Tesone was found guilty of acting on the orders of the Castellammare bosses, Luigi Di Martino, known as the Prophet, and Francis Mallard boss of Giugliano, to favor the Mogavero-Bisogni.
With the overturning of the conviction, a new judicial chapter opens.

"This is a sensational cancellation - says Supreme Court lawyer Dario Vannetiello, Tesone's lawyer together with lawyer Michele Giametta - because the accusation hypothesis, raised by the district anti-mafia directorate of Salerno, had been shared by the judicial authorities up to now given that all the other competitors, judged separately, with the exception of Gennaro Trambarulo, had already been definitively sentenced".
"The evidence of the investigation - explains the professional - consisted of a dense network of messages, sent to so-called dedicated numbers and accompanied by an evaluation of the connections to telephone cells on the day of the crime and on the days of the stakeouts, environmental wiretaps, as well as the statements made by five collaborators of justice.
The central issue, around which the defense has extensively revolved its argument, is the flawed reasoning of the Judges regarding the recognition of Antonio Tesone's voice in the intercepted conversations.
