The Court of Appeal of Naples, first section, panel B, confirmed yesterday, November 25, 2024, the ten-month prison sentence handed down in the first instance to Umberto Brancaccio, a doctor working in the emergency room of the San Leonardo hospital in Castellammare di Stabia, found guilty of manslaughter.
The facts date back to October 5, 2016, when the young Michele Mascolo, 31 years old, a computer scientist living in the Madonna delle Grazie hamlet of the municipality of Santa Maria la Carità, was discharged from the emergency room despite complaining of persistent abdominal pain. Michele died during the night, about 20 hours after the discharge, following a new emergency hospitalization.

The Mascolo family, composed of father Renato, mother Immacolata Somma and siblings Raffaella and Salvatore, commented on the sentence by thanking the judiciary for the attention shown towards a case that has profoundly affected their lives. “Michele was a boy at the beginning of his life, who passed away through someone else’s fault,” they declared. The family hopes that similar episodes will always be prosecuted to prevent them from happening again in the future.
A case that reignites the debate on medical liability and the importance of careful monitoring in cases of health emergencies.

I read the article and I think it is very important to reflect on how doctors should be responsible. It is sad that a life was lost, especially so young. I hope that justice can take its course.
the sentence is something that makes you think a lot, there are many factors to consider. It is not right that a doctor is condemned if there are circumstances that do not depend only on him. It is important to reflect on how to improve the health system.
