Gaetano Pesce's Pulcinella installation in Piazza Municipio, Naples, has become the subject of a legal controversy. Fashion designer Gianni Molaro has filed a lawsuit against the work, claiming it is a plagiarism of one of his creations from the mid-90s.
According to Molaro, the characteristic shape of the Pulcinella Fish, with the top hat and collar, would be a revisited copy of one of his sculptures published in various interior design magazines.

In his complaint, Molaro speaks of "evolutionary plagiarism," meaning a reworked copy that, while not identical to the original, retains the central idea and violates copyright. The artist has therefore requested the seizure of the work, clarifying that his intention is not to attack the city administration, but to have his authorship of the original idea recognized.
