Siena. The alleged “infiltrator” was acquitted, the two perpetrators of the robbery at the Chianti Banca Credito Cooperativo branch in San Gimignano, which took place on March 30, 2022 and yielded a loot of over 152 thousand euros, were convicted.
According to the prosecution, Gennaro Perez, 33, originally from Naples, was the external accomplice, responsible for monitoring the area around the bank during the robbery.
However, the preliminary hearing judge of the Court of Siena ruled that he should be acquitted, thus rejecting the request of the public prosecutor, who had asked for eight years of imprisonment for all the defendants.
After the abbreviated trial, the judge instead sentenced the two perpetrators of the robbery, Vittorio Tascone, 28 years old, and Luigi Moschera, 29 years old, to five years of imprisonment respectively.
The sentence, by virtue of the recent provisions of the Cartabia law, could be reduced to four years and two months if no appeal is filed. The defendants are defended by lawyers Paolo Bufalini, Luigi Poziello and Guido Iaccarino.
The dynamics of the robbery: threats and theft of 152 thousand euros
The robbery took place a few minutes before the branch closed. According to the prosecution's reconstruction, the two robbers, Tascone and Moschera, had entered the bank with their faces covered by masks and hats, while Perez and an unidentified accomplice guarded the outside as "lookouts".
Once inside, Tascone allegedly threatened the deputy director with a box cutter, telling him not to resist, saying things like, “There’s a robbery going on. Don’t try to screw us over. Don’t do anything stupid.”
Under threat, the deputy director was forced to unlock the ATM and vault safes, allowing the robbers to steal €152.710 in cash, which was stolen from the branch and its rightful owners.

It is very strange that an accomplice who is outside can be acquitted while the two material authors are convicted. It seems to me a somewhat unfair situation for those who suffered the robbery and lost money.
