The Nola Court sentenced doctor Stefano Cristiano to two years in prison for the manslaughter of Raffaele Arcella, a 29-year-old man from Caivano who died in 2019 following gastric bypass surgery. The judge granted the requests of the public prosecutor and the victim's family, represented by attorney Fernando Maria Pellino.
The autopsy revealed the presence of a foreign body, the nose cone of a probe, inside Arcella's abdomen, a detail that highlighted a series of negligences during the surgery. Despite the symptoms of a post-operative infection, the doctor did not perform the necessary tests, including a CT scan with contrast, to identify the problem.
One case of medical malpractice among many
This is the same doctor who performed surgery on Francesco Di Vilio, a 69-year-old Samaritan (who also died after surgery). This is the same surgeon – Dr. Cristiano – who operated on Angela Iannotta (who also underwent bariatric surgery by Dr. Cristiano and was saved in extremis, with abdominal reconstructive surgery, performed by Prof. Francesco Corcione).
Yesterday the sentence of conviction of the Arcella trial: issued by the Judge of the Court of Nola, Dr. Alessandra Zingale who accepted the requests of the Public Prosecutor for a hearing and of the defense of the civil party, the lawyer Fernando. Maria Pellino. Conviction also to the compensation of damages to be liquidated in civil proceedings in favor of the heirs of poor Raffaele. The surgeon Dr. Cristiano was answering for the crime of homicide due to professional medical negligence.
Always for the same charge, Dr. Stefano Cristiano is accused before the Sammaritan Court for the death of Francesco Di Vilio while he answers for serious injuries and forgery against Angela Iannotta both subjected to surgery by Dr. Cristiano at the Villa Del Sole nursing home in Caserta; this health facility called into question as civilly responsible by the lawyers Gaetano and Raffaele Crisileo and the first hearing is set before Judge Dr. Villano for next January 16, 2025.

The judge accepted the thesis expressed by the lawyer Fernando Maria Pellino, civil defender of the Arcella family and of the public prosecutor at the court of Nola, Dr. Colonna Romano.
Doctor Stefano Cristiano is under investigation for other alleged cases of medical malpractice that have attracted the attention of the Santa Maria Capua Vetere prosecutor's office, such as that of Angela Iannotta, who found herself at the end of her life after bariatric surgery performed at the Villa del Sole clinic in Caserta, and that of Francesco Di Vilio, an oncology patient who died at the age of 69 after several stomach operations.
