Casal di Principe. Nicola Cosentino's defense had requested a reduction in sentence, arguing a contrast in interpretation regarding the crime of external complicity in mafia association. This contrast emerged from the sentences of two key proceedings: the Eco5 trial and the investigation into vote-trading in local elections, known as Il Principe and the Ballerina Card.
By virtue of this contrast, a request for a reduction of one year of the overall sentence was made, but the court rejected the request. Already in recent months, the Court of Cassation had rejected an extraordinary appeal for error of fact, invoking article 625-bis of the Code of Criminal Procedure.
The defense argued that the Court had erred in its assessment of the documents, in particular the order of May 12, 2021 and other key procedural documents.
Cosentino had complained about the failure to acquire 71 documents considered crucial, presented during the hearing of 28 April 2021 and accompanied by an explanatory memorandum sent via PEC on 4 May 2021. However, this line of defense was also not accepted.
