Nino Capaldo, born in 66 in Frattamaggiore, faces 20 years in prison, accused of murdering Massimo Lodeserto. “Legitimate defense”
Initially, Capaldo was also charged with the aggravating circumstance of premeditation, which was later not confirmed. “He acted in self-defense,” says lawyer Gianluca Orlando, who is assisting the defendant. “When they met, Lodeserto had a fake gun with him. Capaldo saw the weapon and thought it was real.”
The lawyer asked for the acquittal or the reformulation of the crime in excessive negligence of self-defense. Capaldo allegedly hid the body for over three months, until it was found by the police, after a long investigation.
The motive
According to what was confessed, the crime in via San Massimo was due to a question of money related to a woman who had had relationships with both of them. Capaldo began to insistently ask Lodeserto for a large sum of money, until he invited him for a clarification, where the confrontation turned into a tragedy.
