The preliminary investigations judge (GIP) of the Court of Avellino, Fabrizio Ciccone, has established that the new hearing for the immediate trial of Massimo Passariello, 39 years old, originally from Cervinara, will be held on February 5th before the Court of Assizes of Avellino. Passariello is accused of the voluntary homicide aggravated by futile motives and cruelty towards Giuseppe Tirone, 51 years old, also from Cervinara.
Previously, the Court of Avellino had accepted the arguments of defense attorneys Vittorio Fucci and Domenico Cioffi, annulling the proceedings and bringing them back before the preliminary hearing judge (GUP). This decision was taken despite the opposition of the public prosecutor and the lawyers of the civil parties, including lawyers Nicola De Maria, Pierluigi Pugliese and Stincone, present in the courtroom.
The regression of the trial, even without granting the abbreviated trial, has led to the repetition of the preliminary phase of the trial and has caused the terms of the precautionary custody to run. This could lead, in perspective, to the release of the accused due to the expiration of the terms. However, the request for abbreviated trial may be presented again in the preliminary phases of the trial, and the Court of Assizes could grant this benefit at the end of the trial.
According to the prosecution, Passariello doused Giuseppe Tirone with flammable liquid after an argument, setting him on fire. The victim, seriously burned, was transported to the Cardarelli hospital in Naples, where he died after ten days of excruciating suffering.
