Stabbing in Piazza Vari: 7-year sentence for attempted murder

Benevento – An argument that started over "excessive glances" resulted in an episode of violence in square Various, with a heavy toll: one seriously injured and a 7-year prison sentence for attempted murder.

The Court of Benevento (president Fallarino, alongside Palmieri and Telaro) has recognized Antonio De Pasquale, 20 years old, responsible for thestabbing of a 37 year old Casalduni occurred on December 3, 2023. The requests of the public prosecutor Maria Colucci, who had requested the same sentence, were partially accepted, considering the contested mitigating and aggravating circumstances to be equivalent.

According to the investigation, the young man allegedly attacked the victim for "trivial reasons," apparently related to an exchange of provocative glances at a bar. After leaving in a car with two people, De Pasquale returned to the scene and stabbed the 37-year-old twice: once to the chest, near the left shoulder, and once to the side. The victim, hospitalized with a guarded prognosis at the Fatebenefratelli Hospital, survived, although her injuries were serious.

De Pasquale, 19 at the time, was arrested by the Carabinieri and initially jailed, but was later granted house arrest following a ruling by the Court of Appeal. During the validation hearing, the young man explained that the incident began inside the club with an exchange of glances between the victim, some girls, and the group he was part of, his brother, and a friend. The tension continued outside, culminating in a mutual attack.

In particular, De Pasquale claimed that the 37-year-old hit his brother in the face with a chair, causing him to fracture his nasal septum. At that point, to defend himself, he pulled out a pocket knife and injured the man.

During today's hearing, the defense attempted to downgrade the charge, suggesting the crime be reclassified as "aggravated assault" or possibly a brawl. However, the panel of judges rejected this argument, upholding De Pasquale's charge of attempted murder.
