Rome – A sensational decision by the Court of Cassation has overturned theorder of the Court of Appeal of Rome, annulling the confiscation of assets from Griselda Filipi, Christian's partner Casamonica.
The provision, issued on March 8, 2024, concerned an important business complex of the LMA company and a property located in the capital.
The acceptance of the appeal, presented by the lawyer Dario Vannetiello of the Bar Association Napoli, marks a dramatic turn of events in the judicial framework involving Filipi. According to investigators, in fact, the woman is a fictitious owner of assets attributable to the clan Casamonica, with the aim of evading the patrimonial measures.
Serious accusations that also emerge from the criminal trial against him, conducted by the District Anti-Mafia Directorate.
This is the third consecutive success obtained by Filipi in Supreme Court, a very rare event in the clan's judicial history. Before this annulment, the Supreme Court had already overturned two decisions: on January 12, 2021, when the Second Section annulled with referral the order of the Court of Rome relating to the accusation of mafia association, and on November 24, 2023, with the annulment of the conviction for participation in a mafia-style association.
The outcome was different for Giuseppe and Guerrino Casamonica, whose appeals were rejected, making the confiscation of their assets definitive. The Court of Cassation, however, accepted the appeals of the civil parties Liliana Mattei, Gianfranco Mattei and Angelo Bruni, as well as those of Katiuscia Casamonica and Valentina Pisciottu, subjects considered marginal in the main proceedings.
Now the attention shifts to the reasons for the Supreme Court's decision, which could open up new legal scenarios. For those who obtained the annulment, the case will return before a different panel of the Court of Appeal of Rome, which will have to rule on the matter again.
