Benevento – The preliminary hearing before the preliminary hearing judge (GUP) Maria Di Carlo, originally scheduled for today, has been postponed to October 2 due to the impediment of one of the defense attorneys.
The hearing concerns eleven people for whom the public prosecutor Giulio Barbato has requested the indictment as part of an investigation conducted by the Guardia di Finanza. The investigation focuses on alleged false appeals for injunctions against TIM and Wind.
Among the defendants are five lawyers: GB of Montesarchio, GN of Napoli, MM of Cervinara, FP of San Martino Valle Caudina and MDS of Airola. Together with them, the owner of a telephone shop, FP of Santa Maria a Vico, and five other people are involved: DF of Airola, CR of Bucciano, FDB of Montesarchio, RC and CP of San Martino Valle Caudina. The defendants are defended by a large pool of lawyers, including Alessio Ruoppo, Pasquale Matera, Ettore Marcarelli, Fulvio Dello Iacovo, Vittorio Fucci, Luca Cavuoto, Claudio Barbato, Gennaro Maione, Domenico Forgione and Davide Pascarella.
The accusations
The charges, of various kinds, concern criminal conspiracy and forgery, relating to appeals filed before the justices of the peace of Airola, Montesarchio, Cerignola, Mirabella Eclano, Montoro, Canosa, Cervinara, and Pescopagano.

These special powers of attorney, which according to the PM were false, would have misled the judges on the legitimacy of the lawyers involved and on the validity of the requests made by the users. These requests concerned the delivery of contractual documentation relating to telephone utilities, with the consequent issuance of injunctions that would have condemned the telephone companies to pay compensation.
Counterfeits and compensation
According to the investigation, the injunctions issued were based on false statements regarding the right of consumers to obtain the requested documentation. The charge of forgery also concerns the alleged authenticity of the signatures in the special powers of attorney, which were allegedly counterfeit.
Representing the two telephone companies are lawyers Grazia Volo and Ivan Filippelli. The outcome of the preliminary hearing will be crucial to determine whether the charges will be confirmed in a trial.
