Naples – A victory for the residents of Piazza Bellini, a hard blow for the municipal administration since the Court of Naples has condemned the Municipality.
The reason is that they have not been able to contain the noise pollution caused by disturbing noises, in particular by music played in the streets of the historic center.
The ruling, published today, accepts the appeal presented in 2018 by a dozen citizens who for years had been complaining about the excessive noise, especially during the night hours.
Drums, bongos and other amplified musical instruments had transformed the famous square into an open-air stage, disturbing the peace of the residents and violating their right to rest.
The Municipality was ordered to immediately stop the excessive noise emissions and to adopt concrete measures to bring the noise levels back within the limits allowed by law. These included the prohibition of the use of musical instruments without authorization, the establishment of a surveillance service and the installation of sound-absorbing barriers.
“A historic ruling,” said Gennaro Esposito, the plaintiffs’ lawyer and city councilor for Azione. “The Court recognized the citizens’ right to live in a healthy and quiet environment, and condemned the City’s inertia.”
The residents of Piazza Bellini celebrate this important victory, which opens the way to greater protection of the right to silence and quality of life in the city.
