Tax experts protest: “Seizures violate citizens’ rights”. The decision of the Supreme Court is expected in January 2025.
In Naples, approximately 30 thousand notices of assessment and seizures for local taxes and traffic fines are being delivered. These are requests for payment relating to IMU, the tax on second homes, to Tari, the waste tax, and fines for violations of the Highway Code. This was confirmed to Fanpage.it by Napoli Obiettivo Valore (Nov), the company responsible for collection on behalf of the Municipality of Naples.
“Taxpayers – explains Nov – have 60 days to pay the amount due or to request the cancellation or payment by installments of the amounts.” In the meantime, the sending of notifications continues without stopping.
The tax experts' protest
The collection methods adopted by Napoli Obiettivo Valore have ended up at the center of controversy. The Chamber of Tax Lawyers of Naples has harshly criticized the company's actions, in particular for the recent massive notification of seizure notices, which occurred close to a crucial decision of the Supreme Court of Cassation.
“The Court – the tax experts write in a note – will rule on January 22, 2025 on the legitimacy of the acts issued by Napoli Obiettivo Valore. The executive actions undertaken appear inappropriate, seriously damaging to the principles of loyalty and collaboration, and exploit the current legal uncertainty to the detriment of citizens.”
According to the Chamber, the Municipality of Naples entrusted the collection to Municipia SpA, a company regularly registered in the ministerial register, but the latter would have delegated the activity to Napoli Obiettivo Valore, a company that – according to tax experts – would not have the legal requirements to manage such operations.
Nov's reply and the wait for the Supreme Court
Napoli Obiettivo Valore has always defended the legitimacy of its actions, rejecting the accusations of tax experts. However, tension remains high while waiting for the ruling of the Supreme Court, which could overturn the scenario.
Attorney Michele Di Fiore, president of the Chamber of Tax Lawyers of Naples, will represent taxpayers before the Supreme Court. “We will strongly support the illegitimacy of the acts issued by this company and the restoration of legality in the collection of local taxes. It is our duty to defend the rights of Neapolitan citizens.”
In the meantime, the Municipality invites taxpayers to evaluate the options of installment payments to avoid enforcement actions, while the city anxiously awaits the verdict of the Supreme Court.
