Cerciello Murder, Hjorth Blindfolded in Barracks: Court of Cassation Overturns Carabiniere's Acquittal

The Supreme Court of Cassation overturned the acquittal of Fabio Manganaro, a Carabiniere accused of using unlawful restraint measures. Manganaro was accused of blindfolding Gabriel Natale Hjorth at the police station after his arrest, in connection with the murder of Deputy Brigadier Mario Cerciello Rega, who was killed on the night of July 25-26, 2019, in Rome with 11 stab wounds.

The decision to appeal against the acquittal, issued on April 26 by the judges of the First Court of Appeal of Rome, was presented by the lawyers Francesco Petrelli and Fabio Alonzi, civil party lawyers of Hjorth. The Court of Appeal had acquitted Manganaro on the grounds that "the fact does not constitute a crime".

On the contrary, in the first instance, the single judge had sentenced the carabiniere to two months, suspended sentence. The annulment of the acquittal sentence by the Supreme Court has made it necessary to have a second appeal, which will now be held before the Civil Court, limited to the purposes of compensation.

"We express our appreciation - say the lawyers Petrelli and Alonzi - for the decision of the judges of the Supreme Court who accepted our appeal, annulling a sentence that was visibly incorrect in fact and in law and that had excluded the criminal relevance of a very serious conduct of abuse that was unacceptable for a state of law".

It's incredible how justice can sometimes seem confusing. The Manganaro case raises many questions about how the rights of those arrested are handled. We hope that everything will be clarified as soon as possible.
